Terms of Service

Lochmere Help is a private, residents-only marketplace for the Lochmere neighborhood in Cary, NC. It lets neighbors post jobs and offer help to each other. We are a connector only. We do not employ providers, supervise jobs, or guarantee anything about the people you meet through the site.

• You must be a Lochmere resident (or an immediate family member of one) and your account must be manually approved by an admin.
• You must be at least 13 years old.
• If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf before you create an account, and is responsible for your activity, payments, and conduct on the site.
• One account per person. Don't share your login.

• Use accurate information (real name, real address, real photo).
• You are responsible for everything that happens under your account.
• Admins can suspend or remove your account at any time, for any reason — including if you no longer live in Lochmere.

Don't use the site to:

• Harass, threaten, or discriminate against any neighbor.
• Offer or request anything illegal, dangerous, or sexual.
• Offer work that legally requires a professional license you don't hold (electrical work, plumbing past minor repairs, medical care, etc.).
• Solicit for outside businesses, recruit, spam, or scrape the site.
• Misrepresent who you are or what you can do.

Admins may remove content and revoke approval for any conduct that hurts the neighborhood.

When you post a job, send a proposal, or hire a neighbor, you are entering an agreement directly with the other neighbor. Lochmere Help is not a party to that agreement, is not an employer or contractor of either side, and makes no promises about quality, timeliness, safety, or outcome of any work performed. You are responsible for your own due diligence — ask questions, check reviews, and trust your judgment before hiring or accepting a job.

Payments on the site are processed by Stripe and governed by Stripe's terms and policies. Holding funds, releasing payment, refunds, chargebacks, and payment disputes all follow Stripe's process. We do not guarantee any funds, do not advance money to anyone, and are not responsible for payment outcomes between you and another neighbor.

You use this site at your own risk. To the fullest extent allowed by law, Lochmere Help and its operators, organizers, and volunteers disclaim all liability for any injury, illness, property damage, theft, loss, dispute, emotional distress, or any other harm arising out of or related to your use of the site, your interactions with other neighbors, or any job arranged through the site — whether the harm is direct, indirect, incidental, consequential, or otherwise.

The site is provided "as is" and "as available," with no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.

If a court finds we are liable to you for anything despite the above, our total liability is capped at the greater of (a) USD $100 or (b) the fees you actually paid to Lochmere Help in the 12 months before the claim (which, today, is $0).

You agree to indemnify, defend, and hold harmless Lochmere Help and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the site, the jobs you post or perform, your interactions with other neighbors, or your violation of these Terms.

You keep ownership of the content you post (photos, job descriptions, reviews, messages, profile info). By posting it, you grant Lochmere Help a non-exclusive, royalty-free, worldwide license to host, store, reproduce, and display that content for the purpose of operating the site for other approved residents. You confirm you have the right to post what you post.

To run the site we collect things like your name, address, email, photos, payment info (via Stripe), and the activity you take on the site. We use this information to operate the site, match neighbors, process payments, and communicate with you. A separate Privacy Policy with more detail will be published; for now, please contact us with any questions.

Admins may suspend, restrict, or remove your account at any time and for any reason, including violation of these Terms, no longer being a Lochmere resident, or conduct that hurts the community. You may close your account at any time by contacting us.

We may update these Terms over time. If we make material changes we will let you know in the app or by email. Your continued use of the site after the new Terms take effect means you accept them. The current version is shown at the top of this page.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Before filing any formal claim, please contact us so we can try to resolve the issue informally. Any claim that can't be resolved informally will be brought in the state or federal courts located in Wake County, North Carolina, and you consent to their jurisdiction.
